Terms of Service

§ 1 scope

These general terms and conditions (below: "AGB") apply to all contracts, deliveries and other services of Crazy OWL SA, Hittnauerstrasse 8, 8330 Pfäffikon ZH (below: "Seller"), regarding the online shop, www.schminkparadies .ch,, and all sub-domains belonging to the domain. Deviating regulations of the customers do not apply, unless the seller has confirmed this in writing. Individual agreements between the seller and the customers always have priority. The deliveries are limited to the field of Switzerland and the Principality of Liechtenstein. Conditions of the customer or deviating or deviating from these terms and conditions are not recognized, unless the seller would have expressly agreed and in writing. § 2 Information about products and services

§ 3 prices

If nothing else is noted, all prices apply, including VAT and plus shipping costs.

§ 4 availability

The seller attaches great importance to carefully maintaining the availability information and to be shown correctly as possible. However, all information on delivery times is without guarantee. If an article cannot be delivered within 10 days due to delivery delays or the time agreed with the customer, the order can be revoked. This does not apply to pre-orders in which the delayed delivery date was already known. The delivery can also be completely impossible if a product can no longer be produced or delivered. In this case, a delivery facility (dissolving condition) occurs in accordance with Section 5 of the General Terms and Conditions.

§ 5 Contract conclusion

Products, services and prices that are published under the above website are considered an offer. However, this offer is always under the (dissolving) condition of a delivery facility or a faulty price (on the part of the manufacturer or the seller). The contract is concluded as soon as the customer gives up his order via the online shop, in the shop, by phone or email. The arrival of an online order is shown to the customer by means of an automatically generated order confirmation to the email address provided by him. The receipt of the automatically generated order confirmation does not contain a promise that the product is actually available or can be delivered. It only indicates the customer that the order submitted has arrived at the seller and the contract has thus come about, which is on the condition of the delivery facilities. If delivery is impossible in accordance with Section 4, the contract will be resolved immediately and automatically. The customer will be informed immediately. If the customer has already paid, this amount will be refunded. Once no payment has been made, the customer is released from the obligation to pay. As a result of such a contract termination, the seller is not obliged to deliver a replacement.

§ 6 terms of payment

6.1 General The customer undertakes to pay with the payment options provided. The current payment options and the associated conditions are published on our website. The seller reserves the right to exclude customers without giving any reasons for individual payment options. Products that are delivered to the customer remain owned by the seller until the purchase price is paid in full.

6.2 Purchase on account with partial payment option (PowerPay)

As an external payment service provider, the MF Group / PowerPay offers the payment method "Purchase on invoice" on. With the order calculation, you can simply pay your online purchase by invoice. If you do without a payment in the specified time frame, you will receive a monthly bill in the following month for a fee with an order overview. In the case of invoices that are not paid on time, dunning expenses are also incurred.

At the conclusion of the purchase contract, PowerPay takes over the resulting invoice claim and handles the corresponding payment modalities.

§ 7 Delay of payment

If the customer does not fully or partially comply with his payment obligations, all open amounts that the customer owes the seller immediately under any title and the seller can request them immediately and hire further deliveries to him. In the event of an order by advance payment, the seller can provide ten (10) calendar days at the earliest, after the seller has unsuccessfully sent the customer a payment request, to dissolve all affected contracts automatically and without further notice.

§ 8 cancellation and contract termination

Orders are binding in accordance with Section 5 of the General Terms and Conditions and the customer is obliged to accept the service. Subsequent changes at the customer's request are possible in exceptional and free discretion of the seller. The possibility of cancellation depends on the product and the time of cancellation. Depending on the order, the order is free of charge, against a traffic compensation or not at all can be canceled. If the customer does not decrease the products within ten (10) days despite the obligation to accept, the seller can dissolve the contract (cancel) and invoice the traffic costs. In the event of a delivery delay by the seller in accordance with Section 4 of the GTC, the customer is entitled to the right of withdrawal after the agreed delivery date at the earliest. In the event of a cancellation due to non-delivery, the seller reimburses the customer in advance.

§ 9 delivery costs

All deliveries within Switzerland and the Principality of Liechtenstein will be offset against Economy (CHF 4.50 from 45.– goods value) and CHF 9.50 for priority. From CHF 100.– The delivery value takes place free of charge. Costs for cash on delivery and express deliveries at the customer's request are charged separately.

§ 10 The customer's obligation to check

The customer must immediately check the delivered or picked up products for correctness, completeness and integrity. Any defects must be informed of the seller immediately after recognizing, but at the latest within eight (8) calendar days after receiving the delivery. If a delivery arrives with damaged shipping packaging, we ask you to hold this if possible by photo and keep the packaging until we could process the damage.

§ 11 exchange and return

Returns of products, take place and risk of the customer. Returns must be made via the online return center and to be registered in advance. Returns without prior consultation and contact are not accepted. Removals are reimbursed in the form of credits. There is no entitlement to reimbursement.

§ 12 liability

Claims for damages against the seller and their assistants are fully operated, insofar as legally permissible. Liability for indirect damage and consequential damage resulting from use, failure or loss of performance is offset. This disclaimer also applies to all types of direct and indirect damage (ie both personal and material and pure financial damage), which are caused by the customer by incorrect or unfaced use of the product.

§ 13 place of jurisdiction and applicable law

The place of jurisdiction is Pfäffikon ZH. The contract is subject to Swiss law, whereby the UN sales law (CISG) is completely excluded.
